Insolvency & Administration
Our specialisties lie in both Personal insolvency and Corporate Restructuring. We undertake a whole range of services that include Corporate Voluntary Arrangements (CVAs), Individual Voluntary Arrangements (IVAs), Administrations, Receiverships and Liquidations.

Corporate Voluntary Arrangements (CVAs)

If If a company has a viable future, but has cash flow problems then a company voluntary arrangement could provide a solution to achieve the long term viability of the business. A company can therfore be rescued by agreeing upon a composition or arrangement with its creditors and thus avoiding straightforwrd liquidation. This allows the company to carry on trading with a view to improving the position of the creditors.

We will consider all of the available options but if liquidation is most appropriate, we will ensure that the law and appropriate professional standards are complied with and that the rights of all the parties are protected.

Compulsory liquidations are instituted by an order made by the court usually on the petition of a creditor, the company, or a shareholder.

We are able to advise a senior lender or other lender when a company breaches the terms of its borrowing and the creditor wishes to use this enforcement remedy.

Administrative receivership differs from simple receivership in that an administrative receiver is appointed over all of the assets and undertaking of the company. This means that an administrative receiver can normally only be appointed by the holder of a floating charge.

We would ensure regular and bespoke reporting as would be expected, where the principal duty of care is to the appointor, unlike Administration.

Liquidation

We deal with:

  • creditors' voluntary liquidations
  • compulsory liquidation
We have experience in assisting directors in the preparation of proposals for CVAs and in acting as approved supervisors in arrangements.

Individual Voluntary Arrangements (IVAs)

Under an administration, the company and its assets are placed under the control of an administrator and the protection of the court with the rights of creditors in effect “frozen” until the administrator produces his or her “proposals” to deal with the company’s affairs and assets. Formal Administration typically follows a period of planning to ensure that a business can be traded, with a view to maximising realisations for stakeholders, usually through an orderly sale of the business by the administrator.

Receivership

An IVA is an alternative to bankruptcy. An IVA is a rescue procedure for individuals, with debt problems. It is an arrangement with creditors and can be as flexible depending on an individual's own circumstances.

We can assist you in formulating an agreement that may be approved by the creditors and dealing with the formalities required.

Administration

Registered to carry on audit work and regulated for a range of investment business activities by the Institute of Chartered Accountants in England and Wales
